Data Protection Update

Posted by Rachael Smith on 24th Jan 2012 at 15:54

Public Authorities often request evidence of a company’s data protection systems as part of the tendering process. This is to ensure that the company has sufficient protection in place for personal and commercial data.

The legislative requirement has fallen under the 1998 Data Protection Act in the UK. However, Viviane Reding, Vice-President of the European Commission, will this week be announcing the outline for the 2012 European Union Data Protection Reform Directive. These directives are designed to update the EU’s current legislation to reflect the prevalence and importance of electronic communications.

The reform also intends to reduce bureaucracy and make it easier for companies to protect their data. This legislation will supersede the existing data protection legislation in the UK as part of the EU’s goal to create a Europe wide consensus on Data Protection in the digital age.

One of the main considerations for organisations tendering under the new reform will be the need to appoint a designated data protection officer within the company.
