Getting to grips with the Public Services Social Value Act 2012
Posted by Rachael Smith on 10th May 2012 at 8:58
The Public Services Social Value Act was passed in February 2012 and the Government has promised more guidance on its implementation later this year. In the meantime Tender Management Community Services have put together this briefing to help you get to grips with the basics and to start thinking about how you can begin to plan your response to the opportunities and challenges of demonstrating your Social Value.
Under the Act, for the first time, all public bodies in England and Wales are required to consider how the services they commission and procure might improve the economic, social and environmental well-being of the area. All English and some Welsh bodies will have to comply with PSVA including local authorities, government departments, NHS Trusts, PCTs, emergency services and RSLs. (RPs)
PSVA applies to all public services contracts and also to those public services contracts with an element of goods or works. Whilst it doesn’t apply to public work or public supply goods contracts Government expects all Authorities to embed social value in all forms of contracts.
PSVA has been heralded as an important measure in enabling not for profit providers to compete on a more equal footing with private sector providers. The Act enshrines the principle that contracts should not be awarded simply on price but on the broader social and economic benefits.
Social Value involves looking beyond price and evaluating the cumulative benefit to communities arising for an award a contract. For every £1 is spent on services delivery that same £1 should also be generating wider community benefit. At first sight then it looks tailor made for social enterprise.
However it’s important to remember that PSVA does not apply solely to Social Enterprises and Charities; private providers will also be able to compete on the basis of the Social value that they generate and one thing is for sure they will rapidly become highly adept at doing so.
